FOOB icons, LJ and LJ

Okay, to recap: Yesterday, aprilp_katje received this email:

Dear LiveJournal user aprilp_katje,

We have received a report, properly formatted under the provisions set forth by United States law, indicating that your userpics located at http://www.livejournal.com/userpic/52391940/7601742 and http://www.livejournal.com/userpic/52885124/7601742 violate the copyright of another. As such, we direct you to delete these userpics and cease using the material on LiveJournal as soon as possible, but no later
than Sunday October 8th at 12:01 AM EDT, to avoid further action against your account.

If you feel that this report is in error or that your use of the material falls under one of the categories permitted under copyright law, you are entitled to file a counter-notification, also under the provisions
of US law; please contact us for information on how to do this. Filing a counter-notification indicates that you are willing to defend yourself in court against a charge of copyright infringement, and you may be
bound by civil and possibly criminal penalties if you are found liable.

Regards,
Renata

qnjones has filed a counter-notification, and has this to say: I'm an attorney, and I'm going to do some research into the issue. I'll try to share what I learn on here. I think it's disgusting that a thin-skinned millionaire like Lynn Johnston can try to shut down protected speech just because she's got the money to burn.

I think I'm in a particularly good position to argue this because my icon is actually one of the icons Lynn made available on her website for use. There is no question that I have permission to use the image. It's the parody she is objecting to, and that is 100% protected.

IMO, the Lynnions are a bunch of incredibly poor sports. I think I've mentioned before that as unpleased as Bill Watterson was about the peeing-Calvin decals, he did recognize that pursuing legal action would be way more trouble than it was worth. His dispute with the syndicate was the hill he wanted to die on, not the decals. Perhaps, if the Lynnions don't want to be mocked, they could try producing a product that's not such an easy target. Give April a new hairstyle. Resolve this crap with Granthony. Stop making Elly and Mike such big whiny martyrs.

I've also been linked to this PDF. (Haven't read it myself; sorry.) http://www.abanet.org/litigation/committees/intellectual/roundtables/0506_outline.pdf#search=%22copyright%20satire%20law%22 And this is the link for counter-notification: http://www.cs.cmu.edu/~dst/Terrorism/form-letter.html
